At the preliminary hearing Tuesday for the murder of a two-year-old girl that took place in February, Lindsey Thomasson plead “not guilty” to a charge of First Degree Murder.  According to the bench notes. the state presented evidence sufficient to warrant a trial and the defense offered no evidence.  The 25-year-old Thomasson’s trial could be scheduled at the hearing set for January 31

Gardner police say they were called about 2 p.m. Tuesday, February 7, to the 400 block of South Hickory Street where the toddler, Presley Kay Porting, was unresponsive. She was taken to an area hospital where she was pronounced dead

A pathologist testified that the little girl suffered a savage beating, which caused bleeding to her brain and around her eyes.

Dr. Michael Handler testified that had Pressley received immediate medical care, the child would have survived her injuries. But that did not happen.

“The child could have been knocked around and placed in bed,” Dr. Handler said. “The swelling of the brain develops and bleeding into the scalp continues and then the child dies.”

Dr. Handler also testified that the little girl had several of what appeared to be bite marks, on her legs, arm, and shoulder.

There were also pattern injuries over the child’s right eye, which the doctor says are consistent with marks made by a ring that police seized from Thomasson.
