Johnson County District Attorney Steve Howe announces that on October 26, 2012, the Grand Jury has come to a decision on the arboretum statue that was the subject to the Grand Jury petition filed on September 4, 2012 in case 12CV6987.
The Grand Jury has advised that they found “No True Bill,” and as a result, no criminal charges will be filed.
The Grand Jury has written a report putting forth their findings. That report states: “We sat for one day and viewed the photographs of the statue. We reviewed the Kansas law and found that the sculpture in question did not meet the legal definition of obscenity set forth in K.S.A. 21-6401(f)(1)(B)(ii).”
The Grand Jury then notified the Court that it had concluded its investigation. The Grand Jury was then discharged with the thanks of the Court.
